How energy contracts are being mis-sold

Did the energy broker tell you how much they made from organising your business contract? Our experiences uncover that most do not. This non-disclosure is a natural route to secure their commissions, as naturally would you sign up to a deal if you knew a significant chunk of your payments were being collected by the broker? Some told, me that broker services were free, or that the broker commissions merely provided as an introducers fee. Typically, most brokers receive their commission payments directly from the contract and supplier they match you with, and it is built into the unit price they arrange for you. Often, this is not disclosed to the customer and thus the significant none-compliance with the law.

  • Is it likely I have been mis-sold an energy contract?
    The figures support that actually 80% of all business energy contracts have a level of commission that was not fully, correctly or lawfully disclosed. The only way to confirm this is to individually assess your situation and ascertain if there are grounds to drive forward to claim.
  • What does the process involve?
    Simply provide us with details of your energy contracts, the details of the broker(s) that organised your contracts and ultimately put these in place. As part of the compliance process you shall sign a letter of authority allowing us to engage with the broker(s) and supplier(s). Hassle free from here on in, we then discuss with the broker(s) and supplier(s) to ascertain the value of your claim. Next is you decide if you wish to launch a claim, should the contract have been mis-sold.
  • How much does it cost to start a claim?
    All of the initial assessment work into your potential claim are completed on a no obligation basis and at zero cost to you. No win. No fee. Our revenue comes from once having established a valid claim exists, as listed within our terms and conditions our fees are sourced from the Solicitors.
  • How long does a claim take?
    On average the claims process takes approximately 5 to 8 days for your initial claim to be assessed and identified as valid. Following on from here the time frame is 6 months. Naturally some cases take less, other longer depending upon their complexities.
  • Who can make a claim?
    Our target audience are businesses, micro businesses, SME organisations, corporate and enterprises, and should you be a sole trader we can discuss your situation too. We seek to resolve all enquiries rapidly and with full transparency.
  • Will claiming effect my contract?
    There are many options for you at this stage. Most likely you will want to restart a new contract with full visibility of the commissions and aligned with your businesses requirements, typically many businesses now striving for green energy to support their ESG strategies. Alternatively, your current broker(s) may remove or reduce their commissions reducing your rate, or possibly they may offer to cancel the contract. Whichever route is preferred we shall always engage with you to ensure any changes have your full permission.
  • How does the commission work?
    A simple example would be your business energy costing 11p/kWh. Energy broker commission cost added at 4p/kWh. Your bill depicts your energy cost at 15p/kWh which you pay to the supplier. The supplier then pays the broker 4p/kWh. This detail if undisclosed constitutes to mis-selling under law.
  • How are hidden commissions possible?
    Energy brokers are not regulated, and OFGEM have no powers (at present) to deal with them. The industry is developing codes of practice, and pushing to have the industry regulated, however in the absence of such regulation, we shall rectify the contracts that have been mis-sold to you.
  • Will I need to attend court?
    Only a very small chance that you may have to personally attend a court hearing. Should this occur then the Solicitor shall with you side by side every step of the way to support and guide you. The energy supplier in question faces escalating legal costs and negative publicity among other reasons that dissuade them from taking a route that requires attendance at trial.
  • Is the broker pursued for the claim?
    No. Whilst we shall discuss the contact the broker for disclosure purposes, the claim shall lie with the supplier for both the commissions and profits made at your expense. These can be backdated to the year 2020, with interest. This route ensures that there can be no avoidance of payment if your claim is successful, even if the broker is no longer trading.
  • What happens if I lose my claim?
    In the unlikely event that your claim is not successful, you will not be expected to cover any legal costs or suffer any consequences as a result of your claim. Zero cost to you. If necessary, you will be protected by an ATE (after the event) Insurance Policy, which ensures that any legal costs you would normally be expected to pay are instead covered, ensuring minimal risk in pursuit of damages owed to your business.
